Terms of Service

1. Description of Service
FlowOS ("we," "us," "our") designs and builds websites for local businesses. Our process begins with a free, no-obligation website concept created for your business before any payment is required. You are under no obligation to pay for or proceed with the project until you have reviewed and approved the concept.
2. Payment Terms
Once you approve the free concept and choose to move forward, we will issue an invoice for the agreed price. Payment (or an agreed deposit) is due upon approval before final build and launch work begins, unless otherwise agreed in writing.
Each project includes three (3) free revision rounds following delivery of the initial build. Additional revisions beyond the three included rounds will be quoted and billed separately at our then-current rate before work on them begins.
3. No Guarantee of Business Outcomes
While we design every site to be fast, professional, and effective, FlowOS makes no guarantee regarding specific business outcomes, including but not limited to increased traffic, leads, sales, revenue, or search engine rankings. Results depend on many factors outside our control, including your industry, market, marketing efforts, and how the site is used and maintained after launch.
4. Client Responsibilities
You are responsible for providing accurate business information, content, and timely feedback needed to complete your project. Delays in providing materials or approvals may delay delivery.
5. Limitation of Liability
To the maximum extent permitted by law, FlowOS and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from or related to the use of our services or any website we build. Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount actually paid by you to FlowOS for the project giving rise to the claim.
6. Intellectual Property
Upon full payment, ownership of the final website design and content created specifically for your project transfers to you. FlowOS retains the right to showcase completed work in its own portfolio and marketing materials unless you request otherwise in writing.
7. Termination
Either party may terminate a project prior to completion by providing written notice. Any work completed and approved up to the point of termination will be billed at a fair, prorated rate.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
9. Changes to These Terms
We may update these Terms of Service from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
